1. The contest “Peraduan Beli & Menang” is organised by Gene Martino Apparel Sdn Bhd (Organiser) and the contest is opened to all Malaysian only with the exception of Gene Martino Apparel Sdn Bhd’s employees and employees of agencies appointed in relation to this contest.

2. The Contest will run from 24th April 2020 until 21st May 2020 or any other period as may be notified by the Organiser (hereinafter referred to as “the Contest Period”).

3. “Contestant” shall mean an individual who participated in this Contest in accordance with the terms and conditions set out herein.

4. To participate in the Contest, Contestants are required to follow the steps below:-
a. Purchase any items of Gene Martino with a total of minimum RM 200 and above in a single receipt by online (Gene Martino’s official WhatsApp/Website) or offline within the Contest Period. Get the receipt as a proof of purchase.
b. Contestant must LIKE the Facebook page @Ge.martino and Follow @genemartino.my Instagram to be eligible to join this contest.
c. Contestant must upload the valid receipt in the comment section of the contest post in order to participate the contest.

6. The weekly contest period is as below:
Week 1: 12:00 am 24th April 2020 – 11:59pm 30th April 2020; 
Week 2: 12:00 am 1st May 2020 – 11:59 pm 7th May 2020; 
Week 3: 12:00 am 8th May 2020 – 11:59 pm 14th May 2020; 
Week 4: 12:00 am 15th May 2020 – 11:59 pm 21th May 2020.

7. There will be (20) twenty weekly winners, to be randomly selected for (4) four weeks. Five [5] entries will be randomly selected per week, based on the valid receipt image that are uploaded in the comment section of the contest post. The winner of the grand prize will be randomly selected at the end of the contest period. Winners of the Contest must private message her/his personal information (name, phone number, email and address) to “Facebook Page” @Ge.martino within 2 days after the winner announcement.

8. If the selected winner does not contact the organiser after 2 days of the winner announcement, he/she will be considered disqualified and will be replaced with another winner.

9. The Organiser reserves the right to request proof of valid receipt for confirmation. Participants must keep the original receipt presented in the contest entries for confirmation of the winner and redemption of the prize. The receipt should be sent to the organiser within a week. Failure to show the valid receipt upon request will result in cancellation of qualifications and rewards. Any unauthorized copies of receipts will also be disqualified and the Organiser reserves the right to replace the winner or cancel the prize. All costs, fees and/or expenses related to the participation and confirmation of participation are the responsibility of the participants and winners.

10. The Winners announcement will be published in Gene Martino Apparel Sdn Bhd social media (Facebook & Instagram).

11. Grand Prize Winner is entitled to win Ringgit Malaysia Two Thousand [RM2000] cash prize. The prize will be in the form of cash/cheque. The Grand Prize winner must go to the appointed Gene Martino Apparel Sdn Bhd outlet to collect the prize. 20 weekly winners are entitled to win Ringgit Malaysia One Hundred [RM100] cash prize. Prizes will be given in the form of cash/cheque and will be couriered to the address provided/direct bank transfer.

12. The prizes will be released/couriered to the winner within 14 days/2 weeks after the winners are contacted.

13. Contestants may upload as many entries as they wish during the Contest Period. Weekly winners are also eligible for Grand Prize.

14. All prizes are given “as is” basis and are not exchangeable with products and/or cash, whether in part or in full. In the event the shortlisted contestant is disqualified, the next contestant in the winner queue will be the replacement shortlisted contestant.

15. At the end of the Contest Period, all eligible Entrances received during the Contest Period will be chosen randomly to determine one [1] Grand Prize Winner only. The Grand Prize Winner selected will win Malaysian Ringgit Two Thousand [RM2,000] cash/cheque.

16. Any Contestant found cheating or attempting to cheat, will risk disqualification or losing his/her prize. Cheating in this context is defined as any effort made, consciously or accidentally, to deviate from the standard and expected progression and technique of playing contest by the Organiser. The Organiser has the sole discretion to determine where such cheating or attempt to cheat has occurred and the Organiser’s decision shall be final. No notice of disqualification or barring will be given to those found cheating or attempting to cheat.

17. All Prizes will only be delivered to valid Malaysian addresses. Any risk of loss or damage to the Prize will pass on to the winner upon send out via courier and provision of the tracking code. The Organiser shall not be liable for or obliged to recognize or replace any defective, lost, damaged or stolen prizes where such defect, loss or damage is not due to the fault or negligence of the Organiser.

18. All charges on prizes, including bank charges, will be the responsibility of the winner. Taxes as applicable will be deducted at the source for all prizes or shall be deposited in advance by the winner and produce proof before claiming the prize. As a condition of accepting the prize, winners may be required to sign any legal documentation as and in the form required by the Organiser and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.

19. To the extent permitted by law, winners shall assume full liability and responsibility in case of any liability redemption and/or usage of the prizes. All costs related in this participation contest and to redeem the prizes are the sole responsibility of the winner.

20. The Organiser shall reserve the right to publish, use the names and/or photographs and/or videos of the winners as materials for the purposes of advertising and/or trade publicity, without any prior notice to the winners and the winners shall not be entitled to claim ownership or other forms of compensation on the materials.

21. The Organiser reserves the right to modify, suspend or cancel this Contest in the event that it becomes not capable of running as planned, technically interfered or corrupted, including but not limited to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Organiser, despite the best efforts of the Organiser.

22. The Organiser holds the right to change/amend the terms and conditions of this Contest without any prior notice to the contestants. Contestants may receive future promotional messages from the Organiser.

23. Decisions by the judges are final relating to all aspects of the selection and disqualification process and results and no correspondence will be entertained. Judges may disqualify any entry if contestant or related parties violate any of the Terms and Conditions attached to the Contest.

24. By participating in this Contest, contestants agree to be bound by this Contest Terms and Conditions, and the decisions of the Organiser. Neither the Organiser, Organiser’s representative offices, business partners, authorized agencies, appointed representatives or any other associated sponsors associated with the Contest shall be held liable for any failure or omission to carry out the Contest in accordance with these terms and conditions.

25. By participating in this Contest, you understand and accept in accordance with the terms contained herein that the Organiser may elect to use and/or process your personal information. However, if for any reason you do not consent to the processing of your personal information, you have the right to reject such consent by contacting the Organiser at the contact details set out below. The personal information that we use and/or process about you includes your name, mobile number, e-mail address and identification card number which have been provided by you in the course of the draw for internal and/or external marketing purposes through SMS, Email or Call whilst ensuring that your privacy & confidentiality is accorded the highest priority. You agree that the Organiser may collect and retain any personal information provided by you, whether through the website or in other ways, and use any such information for its legitimate business purposes which includes, but is not limited to administering your participation in the draw as well as to market existing, future related products and services to you. You also agree that the Organiser may use information provided by you in aggregate form for the purposes of performing and publishing industry statistics and analysis, provided that any such information does not personally identify you. You acknowledge that your entry into the Contest is dependent upon the provision of your information. The Organiser reserves the right at all times to disclose any information that may be provided in the course of the Contest as is necessary to satisfy any law, regulation or governmental request, or to refuse to post, or to remove, any information or materials, in whole or in part, that in the Organiser’s sole and absolute discretion are objectionable or in violation of this Agreement. Furthermore, the Organiser may also disclose your information to any of its agents, third party service providers, and its appointed representative and associates companies as required for purposes pertaining to this Contest as well as for business related purposes.

27. Pursuant to the Personal Data Protection Act 2010, you are entitled to access, limit, and / or request for the correction of the personal information the Organiser may hold about you at any time. A fee may be charged for any reasonable costs incurred in responding to any such request. This fee will be disclosed to you prior to any costs being incurred. Your rights of removal may be subject to any additional terms which apply to the relevant list or service. 28. In the event of any discrepancy and/or inconsistencies between the terms and conditions of the English version and Bahasa Malaysia version, the English version shall prevail. In the event of any discrepancy and/or inconsistencies between the terms and conditions in the advertising, promotional, publicity and/or Contest materials, the terms and conditions in the English version herein shall prevail over any other documents and references.

29. All disputes relating to this Contest shall be subject to the exclusive jurisdiction of Courts at Malaysia only.
